today the top universities in the world are are in america. we should be proud of that and take advantage of it. >> sean: good to see you. thank you for being with us. let not your heart be troubled. greta is next. see you back here tomorrow night. >> greta: this is a fox news alert. late tonight the senate passing a bill to end air traffic controller furloughs. but the national uproar over flight delays the senate voted unanimously to approve the measure to provide enough funding for traffic controllers through september 30. the house must take up the bill and they vote on it tomorrow. more breaking news on this later. first, next target, new york city. >> last night we were informed by the fbi that the surviving attacker revealed that new york city was next on their list of targets. >> subsequent questioning of dhokhar reveald that he and his brother decided spontaneously on times square as a target. >> they had built these

additional explosives and we know they had the capacity to care relationship out the attacks. >> the parents of the bombing suspects are ar talking. >> i thought america was going like protect us, our kids were going to be safe for like any reason but it happened. america took my kids away from me. >> this as fox news learns the mother may have known two years ago her mother had been radicalized and willing to die for islam. >> bin laden may be dead but radical islam is alive and well and this administration let their guard down. >> lawmakers voicing disappointment that the interrogations shut down prematurely. >> the fbi did not know the judge was coming or the magistrate was coming. a total mismanagement at best from the top. >> lawmakers say fbi agents were taken by surprise when the magistrate arrived and read him

his rights. >> between benghazi and boston our systems are failing and we are going backwards. radical islam is on the march and we need to up our game. >> greta: a spontaneous decision that could have led to disaster. the new york city police commissioner saying they were headed to times square armed with six bombs. rudy giuliani. >> greta: no doubts thoughts about the threats of going to times square your old stomping grounds as mayor. >> predictable. new york is a major target. it looks like it was according to at least the original information a spontaneous decision. once they knew they were going to be caught it was kind of the end game. they were escaping and going to do one more bombing in times square. always unfortunately a target, as worried me every new year's eve going back to even way

before september 11th we were always concerned about terrorist attacks during the new year's eve celebration. made tremendous preparations to it try to' void it and in 2000 almost canceled it because of some not quite specific but you pretty dangerous threats about times square. >> greta: there is some surveillance cameras in times square but surveillance cameras allow you to catch the person. not necessarily to prevent the crime, to prevent the bombing. that is the problem. >> one thing that ray kelly and mike bloomberg have done since september 11th is really trained the new york city police department to be about as good as observing what bill bratten describes as the precursors of terrorism meaning the suspicious activity that might lead to a terrorist attack. so even if they had come here i have some hope that given the training the new york city police department has had maybe we had a chance to stop them. but, you know, thank god it never happened and you don't have to test that.

>> greta: a tremendous amount of training and surveillance cameras but you that is tremendously expensive. times square is sort of an obvious target but you cities like milwaukee, denver, houston just as vulnerable and don't have the money or o the training. >> and don't have the size of the police department. new york is fortunate. five counties in one city so we end up with 35,000, 40,000 police officers. so you can put aside a thousand, 2,000, three thousand and train them specifically in detecting terrorism. most cities don't have that flexibility. that is quite true. but then again, new york city is along with washington, d.c. probably right at the top it of the list all the time whenever you arrest these guys. it is always an interest in new york or washington. >> greta: these guys were peculiar. they bombed in boston. they apparently had no exit strategy. basically hung around the neighborhood until they got

picked up and then there was talk about going to new york. it was sort of odd. it wasn't like this is part of an elaborate plan. just seem thed violent. >> contradictions in the way in which they did the bombing in boston was professional. looked cool in the way in which they did it. got the bombing off effectively. that was professional. the end game was completely amateurship and the plan about new york was an afterthought. had six bomb left and were are going to try to go out in a blaze of glory. i mean the real issue here now as we come away from this is all of the opportunities that we had in advance at least to catch the older brother at least to keep focus on the older brother and we didn't. and rather than trying to look at that from the point of view of blaming anybody, we should look at it from the point of view of how the heck are we going to straighten that out so we don't make that mistake again. that was a big set of mistakes that were made with the older

brother. >> greta: somebody talked to him. someone from the fbi went out and talked to him. has to be records some place. i think we should start there by examining what did the special agent information did he or she get and where did it go? >> and maybe loosen up the rules about categorizing these people. one of the fbi agents said he thought it would be illegal to keep the guy on the list. nothing illegal about following somebody in the open. nothing illegal about looking at what they have on the internet. that is all public record information. it would be illegal if you broke into his apartment or tapped his telephone. so some of the explanations that i'm getting make me nervous that the fbi is erring on the side of caution when i want them to err on the side of safety. >> greta: speaking of erring on the side of caution the administration of the massachusetts governor duvall patrick will not release information about the two whether they got welfare

benefits or not or food stamps or not for privacy interests to protect the dead one and now the one facing an indictment or facing a criminal complaint. >> what possible privacy interest do you have in that? either got welfare or didn't get welfare and that would be important to how were they financed? i mean i would like to know how much they were getting in welfare. a trip to russia for section months is a pretty darn expensive proposition. i wondered was anybody financing them and if you knew how much they were getting in welfare you would begin to be able to analyze was that enough to sustain this or wasn't it. i think it is important public information. i can't figure out what the heck the privacy interest is ex-is september maybe an embarrassment that by mistake, massachusetts, was giving welfare to potential terrorists. my goodness that was -- if that was the worst mistake that was made it wouldn't be so bad. there are a lot more serious mistakes made than that.

>> greta: the the law enforcement can subpoena the records to get it for the prosecution but we in the media would like to get the information and some in the public might like to know whether or not these people were on public assistance of some sort or not. unavailable to us. what i don't understand is how someone who has obviously been accused of a crime and is dead has a privacy interest. >> and see if the mother is going to get prosecuted for theft. i think there is an outstanding warrant for proceeding against her for theft before she left the united states. >> greta: that is probably why she left. >> i hope we will go forward with that prosecution. that would be another way to put a little pressure on this kid to -- this man to talk. i mean the maximum amount of pressure we can put on this guy to give us the full information. i mean after all, look at that ridiculous thing that happened in interrupting his questioning. just mind boggling. to me, someone who spent most

of his life in law enforcement can't imagine in the middle of questioning the guy is telling you about coming to new york and doing a bombing in new york and a judge walks in and we cut off the question. what are we crazy? >> greta: mayor, thank you. always nice to see you, sir. >> police say he only admitted after repeated questioning. officials say tsarnaev went silent after a judge gave him his miranda warning. representative michele bachmann joins us. nice to see you. >> good to see you, greta. >> greta: you are a lawyer but also object to the procedure of what happened? >> we were shocked yesterday when we heard about this in the intelligence community. democrat and republican alike. we were all shocked we heard this had happened but the problem goes back to the fact that the obama administration filed charges over the weekend against terrorist number two that is what i call him.

they filed the charges and the federal law demands under federal rules of civil procedure five that he must be given his miranda warning. >> greta: so the objection is not with what happened after the charges were filed because the rule is quite plain. the magistrate was right in doing what the magistrate did. >> he was. >> greta: so it was the filing of the charges that set the ball rolling. >> it did. let's look at who we are dealing with. we are dealing with someone who is a terrorist who made a decision to declare war on people who don't agree with him. an islamic jihaddist. he has declared war and therefore that makes him an enemy combatant and even though his status isn't totally proveable for at least a temporary period of time he should have been declared anenmy combatant because we have literally a treasure trove of information coming in to us over the transom and now we have essentially duct tape over

the mouth of this terrorist and can't use him to link together this treasure trove of information and the people hurt the most are the people watching your show and innocent americans all across the united states. that shouldn't be. that is a miscarriage of justice. >> greta: i take it you don't have any -- you agreed that unless he is categorized or determined to be an enemy combatant they were obliged to charge him. the supreme court says you can't hold someone without charges to the u.s. attorney's office was obliged to charge him by a criminal complaint. >> you don't have to do it as quickly as they did but you you doster to it charge him, right. if he goes down the law enforcement route. that is the issue. >> greta: that is what i was going to say unless you relieve the law enforcement of going forward they were obliged to charge him and obliged to do rule five which includes a magistrate and the rights and you have to back up and is there some sort of category, eni combatant does that apply

so that they could have -- >> sure and the good news is president obama could and should designate him an enemy combatant today. he can correct the error and reclassify and we can go back to interrogation. that is what we should be demanding today happens. >> greta: but he already knows he has rights and doesn't have to talk. >> he knows that but the jose padilla case as the precedent and the president is the only one you, the president is the only one who chose that terrorist number two would be charged knowing full well, he would have to be immediately mirandized. the president is also the only one that can declare him an enemy combatant and then we can finally get the information from him through interrogation to link all of the data that we have. we have a lot of very heavy serious information where his input would be extremely crew you shall because let's face it like you heard from mayor giuliani there may have been an attempt to go to new york city next. we also know about the train

that was about to be blown up over niagara falls between new york and toronto. there is a lot of serious matters at hand and we need to think about the safety of the american people. >> greta: just to is summarize and make sure the u.s. attorney did the right thing by charging having no directions by him or her are to do anything to the contrare. >> that is, correct. >> greta: you don't have any beef with the u.s. attorney or the magistrate the beef is with whoever made the decision not to make him an enemy combatant which would relieve him of going through the criminal justice process is. >> and the decision would have o questionnaire rickp level. holder and the president of the united states who made this decision. >> will you ask that eric holder come before the intel committee? >> i already have. >> greta: ahead of me. i should have known that you would be ahead of me. congress woman nice to see you. >> good to see you, too. >> greta: , tonight, new information about the wife of tamerlan tsarnaev.

what did she know? any information about catherine russell the wife? >> quite a bit of information about katherine russell. officials learned in the interrogation of dhokhar tsarnaev that she had called once she saw the fbi release photos and videos on television of her husband and brother in law you dropping the bombs. >> greta: that would have been wednesday night or thursday night? >> thursday night, right. >> greta: she made a phone call thursday night after she saw the video. >> to tamerlan and according to the people i talked to familiar with the investigation gave him a head's up and said they are looking for you. she wasn't sur priced. she didn't call him and say i can't believe you are a part of this. called and said they are looking for you. >> greta: didn't say turn yourself in or you are in trillion or what did you do? >> according to the interrogation she called and gave him a heads up a and said

they are looking for you and the thing investigators believe that started the series of events with the killing of the mit officer and robbing of the convenience store and high speed chase. >> greta: i take it they have the cell phone records and records of tamerlan. >> they do. >> greta: and those corroborate the phone call? >> i don't know that. >> greta: is there any other sort of reason to have suspicion of her? >> i'm not sure at this point that authorities have anything other than what they have gotten from dhokhar tsarnaev. from the beginning of the investigation there was question hes about her. if tamerlan went back and lived with her, spent time with her in the days after the attack, could it be possible that she didn't know what he had been up to. there are real questions. >> greta: i guess if they are living together. i don't know if she is living at home with her parents or living with him some place in the boston area. i imagine they had a small apartment. six pressure cookers coming into the house.

>> the defense that her lawyer provided and people arguing on her behalf have provided say that she is a home healthcare provider and a works 70-80 hours a week and wasn't in the apartment many of the times that he was not the apartment and therefore wouldn't be in a position to know that. i would say as an outsider i find that hard to believe. >> greta: there was an abc tweet that she had a shoplifting charge from 2007. not a big amount of money and that it was dismissed and she did community service and her record was expunged. you know, just notable. doesn't necessary isly make her a terrorist or anything but she has got a little bit of explaining there. >> they are looking more carefully at what she did in the immediate aftermath of the bombing and before the bombing and going back and looking at her more deeply on every level. >> greta: she has denied knowing anything? >> denied through you a lawyer knowing anything and says that she wants to help the investigation. >> greta: she wants to help it. is she cooperating? >> i don't know that. >> greta: is she talking to them or has she been at the fbi

going to be safe for any reasons but it happened. america took my kids away from me. only america. >> greta: the boston herald dave wedge joins us. dave, what were the circumstances for the press conference, do you know? >> well, she is in russia and obviously the media is trying to get answers. and they want to know what she knows about what her sons' activities were before the bombings. >> is there any indication that she knew what the boys -- boys? what the young men were up to. >> i haven't heard any reports to the effect. certainly her statements are troubling what i'm hearing is a's anguish but a lot of what i'm hearing is no remorse. i haven't heard her talk about feeling sore relationship for the victims or anything like

that. all i hear about is america she came to america and america took her sons and that sort of stuff. so, it is you know there certainly there is a lot of questions as to the things she is staying the antiamerican statements she is making herself. it is upsetting to the people here in boston frankly. >> greta: upsetting? i think it is appalling what she said. she is blaming america for taking her kids away when america gave her children asylum, citizenship, benefits, freedom, opportunity and what her sons gave us are bombs and killing four and a bunch of people without limbs. i see no remorse or sadness on this woman's part at all. did she indicate any sadness for the victims at all? >> it doesn't sound like it to me. and you know, these kids -- these guys were, you know, they were given scholarships to our colleges. the younger brother is in the hospital here behind me he, went to a state school we haven't been able to find out yet if he got any sort of aid

for are that. but often times state schools give out pretty generous aid packages especially to foreign students. they were -- you know, they got welfare benefits that we know about and, you know, the feeling here in boston is this is salt in the wound the comments that this woman is making. things are bad enough you and you hear the suspects' talking like this and blaming america tore taking her sons is despicable and hurtful. >> greta: she is on the run with an outstanding warrant isn't she for theft? isn't that why she left the country? >> i don't foe i know if that y she left the country but if she comes back that is something she is subject to arrest. a criminal warrant issued back in october for an old shop lifting case she had. i guess she was charged with shop lifting like a thousand dollars worth of stuff. ironically enough from a

lord & taylor which is where some of the surveillance footage came from a different lord & taylor where the bombings occurred. skipped out on the case and never dealt with it and there is a warrant for her arrest issued. if she does come back to deal with the stuff with her sons she would have to deal with that i would think. >> greta: i would hope that the minute she stepped foot on our soil we would have her answer to her warrant for starters. dave, thank you. the fbi now coming a land fill for evidence near umass dartmouth where dhokhar it tsarnaev went to school. what is the fbi looking for? mike, why at the land fill? >> the search has been going on for at least three days greta. around 25 federal agents. near u-mass dartmouth where dhokhar was a sophomore. looks like investigators think

some perhaps receipts or something linking him to the boston marathon bombing probe is in the area. we have law enforcement officials telling us they are looking for evidence tied to the bombing probe. there were at least three dozen people clad in white suits there for most of the day today combing through trash. people said they were looking at everything, turning over papers, other stuff. i certainly wouldn't want to be there but you all in the search for evidence. one person said the fbi is being very, very thorough. the fbi by the way is not confirming that they are involved this thing. just saying they doing a number of searches looking for evidence in the case. >> greta: mike thank you. a note the bostonglobe .com has an article, interview with a man who o was carjacked and after on the record go to the website the bostonglobe .com and read the art kl. >> incredible story.

workers. what do you think about that, sir? >> justino example of some political gamesmanship by the administration and the president and here we have a situation where we have f.a.a. air traffic controllers being furloughed which is a matter of public safety and very important situations and yet we will have situations with the obama care handlers not being furloughed. >> greta: what is the reasoning? who did they come under? i realize the faa comes under the department of transportation. who did do the obama care workers come under? >> hhs. secretary -- >> greta: why isn't across-the-board a cut there? >> show found a way not to have to do furloughs. they claimed during testimony yesterday in the the subcommittee there were hiring freezes but they are not furloughs. we dealt with an administration here that has done the cancel ising of the white house tours. done the tsa threats of long waits because of tsa even though they did, what,

$50 million worth of new uniforms a week before sequester hit and parties at the white house usin use taxpar money. trying to do whatever to hurt the most people and it is not a fair approach to handle this. >> greta: a lot of people object to it because it doesn't allow us to use a scalpel and determine what is more important than other things. how come this group of people are exempted? i realize a hiring freeze but why aren't they getting a cut like everyone else is? >> that is a great question. what happened in the process, no furloughs but yet remember they cut and stopped the enrollment of those with preex-esting illnesses. something that would be of the most import, most important to people who were suffering. >> greta: that has been cut? >> they canceled the registration for that a couple of months back. >> greta: those are the people who can't get anything some place else. >> yes, we stopped that but yet the secretary has over

$2 billion worth of money in her fund for preventative care that they used to do things like a pet neutering program. and also for lobbying for the soda tax and they are planning on using half of that to hire navigators. so not only have they not furloughed this department within hhs is advertising jobs right now that are open and that they are hiring for. it is just -- it is what we are dealing with with this administration right now which is hurting as many people as possible. >> greta: i'm sure i mean you are saying this is totally political? >> look -- >> greta: and what would they say if they were here? >> they would say if we are talking about just the air traffic controllers they would make argument it is not political and they are trying to make other cuts and i know the senate passed the bill -- i would submit they had the december correction to take care of that without this bill that we will see tomorrow from the senate.
